Finally The Facts: Taken from the complaint filed three days before Heroes was canceled. NBC was first contacted on December 24th 2009 regarding our concerns in this matter.
An official press release will be forthcoming.
One of the most compelling part of this case is presented below in the sequences that occur in both stories and in the same order. Again the pictures are meant to be a supplement to the text. Then below that is the complaint in it's entirety.
Note: Nowhere does this complaint state that Jazan Wild ever suggested that he owned any carnival story but his own. That story alone... not ferris wheels,
house of mirrors or magical carnivals. But rather the below storyline, which is only found in two carnival stories. Heroes and Jazan Wild's Carnival Of Souls. Again this story was first published in 2005. Has been downloaded hundreds of thousands of times. Featured in the LA Times and was the 1st. digital comic on Blackberry's App World in April 2009 and was the number one downloaded ebook for several months. It is currently number three.
THE CHASE SEQUENCE AND MAGICAL CARNIVAL APPEARANCE
Both stories have either a Carney or Hero, running through a remote wooded area while being chased by an angry mob, who believes the Carney or Hero has committed murder. A girl then cries out to the protagonist as he escapes into the wooded area. In both HEROES and CARNIVAL OF SOULS, it is at this point that a magical carnival appears and saves the Carney or Hero. Then, the magical carnival disappears before the angry mob can reach the collected Carney or Hero. (See Exhibit 2A, 2B, 2C and 2D.)

EXHIBIT 2 A
(NOTE: In the above, both Carnival of Souls (on the left) and Heroes (on the right) have female characters call out to the protagonists as they flee from an angry mob. Both protagonists have been accused of murder. The angles in both scenes are the same. The Heroes’ scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 2 B
(NOTE: In the above scene, the protagonists both see a glowing light in the distance. As they approach, they are wide eyed and surprised at what they see, as a Carnival appears in the middle of nowhere. The camera angle of both characters is substantially similar. The Heroes’ scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 2 C
(NOTE: In the above scene, both protagonists see the Magical Carnival that has appeared in the remote wooded area. Both Magical Carnivals have a character with outstretched hands welcoming the protagonists into a ghost-like deserted carnival. The camera angle of both characters is substantially similar. The Heroes’ scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 2 D
(NOTE: Above is where both protagonists enter the Carnival. After entering the Carnival, it magically disappears and fades away, right before the angry mob can reach the protagonists. The camera angle of both scenes is substantially similar. The Heroes’ scene seems to be directly storyboarded from Carnival Of Souls.)
THE HOUSE OF MIRRORS SEQUENCE
In both HEROES and CARNIVAL OF SOULS, the protagonist enters the house of mirrors, which then encircles him. He sees his mother, who calls out his name and reveals dark secrets to him, causing him to cry out in pain. (See Exhibit 3A, 3B and 3C.)

EXHIBIT 3 A
(NOTE: Above is the “House Of Mirrors” from both series. The camera angle of the House Of Mirrors and the design, specifically the title above the entrance and pull away red curtains, are substantially similar. The scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 3 B
(NOTE: Above is where both protagonists have their names called out to them and both protagonists then reply “Mother / Mom” when their dead mother appears to them in the mirrors. The camera angle of both characters as well as the circular House Of Mirrors design are substantially similar. The scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 3 C
(NOTE: After both protagonist hear their dead mother call to them, they both cry out in anger and pain when they are told dark secrets by their dead mother. Both characters cry out with their dead mother over their shoulders behind them in the mirrors. The camera angle of both characters is substantially similar. The scene seems to be directly storyboarded from Carnival Of Souls.)
THE HOUSE OF MIRRORS KINETIC ENERGY BLASTING FROM HANDS
A second identical scene involves the Evil Character entering the house of mirrors and blasting electricity out of his hands. (See Exhibit 4A and 4B.) These storylines are original, distinct and specific to CARNIVAL OF SOULS and were created, published and placed in the stream of commerce before HEROES.

EXHIBIT 4 A
(NOTE: Above is where both stories have an evil character enter the House Of Mirrors and blast an enemy with Kinetic Energy from his hands. The camera angle is substantially similar. Both are overhead shots as the evil character enters. The design of the mirrors is similar, as is the darkness behind the mirrors. The scene seems to be directly storyboarded from Carnival Of Souls.)

EXHIBIT 4 B
(NOTE: Above is where in both stories the evil characters shoot Kinetic Energy from their hands while in the House Of Mirrors. The camera angle is substantially similar, as is the position of the characters.

Alright this is kinda funny.
We listed our Jazan Wild Carnival Of Souls Chapter 4 app
for sale on Google's Android G1 Phone market.
Well we left off the decimal before the 99, so the next morning
Sharon (who runs things at the Carnival)
awoke to 200 emails that called us everything in the book.
Are you a *** moron, Go **** yourself and the horse you rode in on, You ** ...
Well you get the point. That's what happens when a
Clown is the head of your company. Get it... clown!!!!!!!!!!!
So now, we have been honored to have made
the "Top 10 Expensive Google Android Apps" list! Yea!!!!!!!!!
No more emails please. It was a typo.
But what's cool is Kevin showcases a really terrific new frontier for music and art.
Sadly we are having to work out some ghosts still in the phone it's self.
But once the memory issues and saving what you download etc... is worked out,
this could be a way to reach the entire world.
Pretty Cool! Believe, Jazan
Any way have fun and check out the list and see my blunder:
